The breaking news out of the California Supreme Court is that they WILL entertain a full merits consideration of the question certified to them by the 9th Circuit in the Perry v. Schwarzenegger.

Schwarzenegger Proposition 8 marriage equality appeal. the 9th has dismissed Imperial county’s attempt to intervene, and certified the remainder of the case to the California Supreme Court for a determination of the issue of standing, which it held to be a state law issue.

Judge Walker has made his decision on the motion to stay his judgment in the Proposition 8 case.

The governor and Attorney General of the State of California have filed formal briefs opposing the stay of Judge Walker’s decision in the Proposition 8 case that the law is unconstitutional and cannot stand. This gives cover to Judge Walker to deny the stay and he is likely to do just that.
