Daniel Levin, when he testified before HJC last year, said he did not speak with David Addington–or anyone else at OVP–during the drafting of his 2004 torture memo. He seems to have been the only torture memo author who did not communicate directly with Addington during the drafting of the memo.

And both Gonzales and Robert Mueller revealed that John Ashcroft–from his ICU bed–complained that his advisors had not been able to get read into the program and as a result he was ill-informed about the program.

The NYT claims that Jim Comey agreed that waterboarding was legal. But that’s not what they show. Rather, they show that Jim Comey probably agreed that waterboarding did not violate 18 USC 2340-2340A, which is just one of the laws that govern torture in this country.
