Judge Sullivan Rejects DOJ’s Expansive Claims to Protect Cheney Interview

By: emptywheel Thursday October 1, 2009 9:48 am

Judge Sullivan has rejected DOJ’s most expansive claims they used to try to protect Dick Cheney’s CIA Leak case interview.

I am reading this now for more detail, but the key graph is this one.

For the reasons stated above, the Court concludes that the agency has met its burden of demonstrating that certain limited information was appropriately withheld from disclosure to protect the well-recognized deliberative process and presidential communications privileges under Exemption

Does Lanny Breuer Have a Conflict in the Cheney Interview FOIA Case?

By: emptywheel Wednesday August 5, 2009 2:37 pm

Lanny Breuer provided John Kiriakou, who responded to Dick Cheney’s inquiries at CIA about Joe Wilson, with at least $5000 of legal services. “Protecting” President Cheney, Too

Obama’s DOJ is still inventing an “embarrassment exemption” for FOIA, to prevent us from learning what Dick Cheney said to Patrick Fitzgerald as part of the CIA Leak investigation.

Im-me-di-ate: adjective (DOJ) 1. More Than 2 Years

By: emptywheel Wednesday July 8, 2009 4:10 pm

The fact that Dick Cheney’s lawyer has already leaked the contents of his interview with Fitzgerald utterly devastates the government’s arguments for keeping his interview materials secret.

Cheney Interview: The New Jon Stewart-Worthy Excuses

By: emptywheel Thursday July 2, 2009 6:16 pm

I think the DOJ is trying to distract Jon Stewart from laughing at Cheney by making a farcical argument about why his interview materials can’t be released.
