New York’s Enlightenment & Some Thoughts On Perry Prop8 Case

By: bmaz Saturday June 25, 2011 7:55 am

New York gets it done on marriage equality, and it will have many profound, and positive, ramifications for the Perry Prop 8 case.

Judge Questions Government’s Persecution of DADT Activists

By: emptywheel Friday March 18, 2011 8:50 am

I’m busy watching this hearing today (and trying to watch one that happened last week). It’s hard to watch two hearings at once! But I didn’t want you think I was still celebrating St. Paddy’s Day, so for the moment I’ll direct you to this story, another example where DOJ is taking an unreasonable stance [...]

The New Obama Policy On Constitutionality Of DOMA & Boies/Olson Reaction

By: bmaz Wednesday February 23, 2011 11:56 am

The Obama Administration this morning made an abrupt and seismic shift in its legal policy and position on DOMA (Defense of Marriage Act). It is a change that will have far reaching and important ramifications, and already has in the Perry v. Schwarzenegger Prop 8 case.

Today’s Lesson from the White House: Take Hostages

By: emptywheel Wednesday December 22, 2010 5:38 am

As we celebrate President Obama signing into law the repeal of Don’t Ask Don’t Tell, I’d like to congratulate the activists who made it happen. This is the progressive high point of Obama’s presidency so far, and it came because of the hard work of a lot of people who relentlessly fought to win civil [...]

Obama and the Constitutionality of DADT and Other LGBT Discrimination

By: bmaz Friday October 29, 2010 9:55 am

By: bmaz Wednesday October 20, 2010 10:39 am

As expected, the Obama Administration has appealed the DADT injunction to the 9th Circuit. There are, however, some interesting twists.

Judge Phillips’ DADT Order Is Not The Victory Being Claimed

By: bmaz Tuesday October 12, 2010 4:47 pm

By wildly overreaching her injunctive authority, Judge Virginia Phillips has given the Obama White House/Executive Branch legitimate and compelling grounds to appeal that are separate from the critical merits issue of the constitutionality and propriety of DADT, which is a discriminatory and loathsome policy and should be terminated immediately.

By: bmaz Friday September 24, 2010 6:22 pm

By: emptywheel Wednesday September 22, 2010 6:13 am

A Democratic source tells CNN that the event is a fundraiser for the two-term Democratic senator, who faces a very difficult re-election bid this year. Blanche Lincoln just joined Republicans to [...]
