A year after Macondo the Mouth of Hell roared in the Gulf of Mexico, forever altering the ecology and lives of those who depend on the Gulf for their existence, it is business as usual for BP and a complicit Department of Justice.

For the first time since Macondo, the Mouth Of Hell, first blew out in a fiery explosion on April 20, killing eleven men in the process, BP seems to have the well under control and there appears to be no hydrocarbons leaking into the waters of the Gulf of Mexico.

If the Obama Administration and Interior Department Secretary Ken Salazar truly believe in the propriety of their six month moratorium, and are dedicated to fighting through appeal for it, why are their lawyers not acting like it? Are they really not trying because they really don’t care, or are they just sloppy and incompetent? It is one or the other.

Oiled up BP Judge Martin Feldman was required by both statutory and ethical considerations to recuse himself; at a absolute base minimum to disclose his appearances of conflict on the record; but he did neither. Any competent standard of lawyering would mandate the government to raise the issue if they are going to fight Feldman’s ruling; but they have not. The public ought to be asking what the hell is going on here.

A week ago, Florida Senator Bill Nelson stated on MSNBC the BP Macondo well was substantially breached and there may be seepage and leakage from the well reservoir escaping through the surrounding sea floor. It appears Nelson was correct about the breach of well integrity and may well be right about seepage from the sea floor as well.

BP and the US government have yet again been dishonest about the nature and size of the oil gusher leaking into the Gulf of Mexico water; it is over twice the highest estimates to date.

Senator Bill Nelson indicates the most horrific possible outcome is at hand in the BP Gulf Oil Spill, namely that basic well integrity is truly shot and oil and gas have breached the well casing and well bore and are escaping into the rock and out into the ocean through the sea floor.

The LMRP process continues on after the failure of every other action by BP. Meanwhile, the Obama DOJ acts like the eleven deaths on Deepwater Horizon never happened.

The key to unlocking where we stand on this is understanding the exact relationship, and how clearly defined it is, between the parent company “BP Plc.”, the Texas City criminal defendant entity “BP Products North America Inc.” and the Alaska criminal defendant entity “BP Exploration (Alaska) Inc. Also, what exact names are on the permits and leases for the Macondo well project? How do all these fit together and can we pierce these alter egos and reasonably argue that the parent entity BP Plc. is legally, including criminally, liable for all?
