Judge Vaugn Walker has issued an extremely significant decision in the illegal wiretapping case of al-Haramain v. Bush/Obama. He has awarded damages and attorney fees to the plaintiffs on their claims of illegal and unconstitutional surveillance by the US government.

ACLU Appeals 9th Circuit Jeppesen Decision to SCOTUS |

The ACLU, who represents the plaintiffs in Mohamed v. Jeppesen, has appealed from the 9th Circuit en banc decision by petitioning the Supreme Court for certiorari.
“The President Ultimately Made the Call” |

GQ has another of those articles describing Eric Holder’s failed efforts to restore DOJ’s independence and sustain rule of law as Attorney General. There are a few new details in there — such as details of what torture was described in the CIA IG Report but must be among the redactions (notably, strangling of one [...]
Military Encroachment On Civilian Authority & Seven Days In May |
| By: bmaz Wednesday October 6, 2010 2:53 am |
The military is becoming ever more aggressively meddlesome in civilian control and political decision making at a time where the surveillance and communications control of the military is unparalleled. With public unrest from the dire economic conditions, there may be a further militarization of the political leadership.
Obama’s Still Obfuscating about Domestic Surveillance |

Adam Serwer does a pretty thorough job debunking Obama’s lame effort to defend his civil liberties record. When people start being concerned about, “You haven’t closed Guantánamo yet,” I say, listen, that’s something I wanted to get done by now, and I haven’t gotten done because of recalcitrance from the other side. Frankly, it’s an [...]
The Secrets They’re
|

As I noted yesterday (and Glenn has examined at more length), in addition to asserting that the government can target Anwar al-Awlaki … because they said so, the Obama Administration also invoked state secrets in its motion to dismiss the ACLU/CCR suit challenging targeted killings. The Obama Administration has officially positioned itself to the right [...]
With Kagan On SCOTUS, We Are Still Down A Justice |
| By: bmaz Friday September 10, 2010 5:17 pm |
With the long anticipated retirement of Justice John Paul Stevens, it was important for President Obama to appoint and get confirmed a new justice so there would not only be a full compliment of justices on the court, but to insure the ideological balance of the court was maintained. By selecting Elena Kagan, Obama certainly [...]
Letter to Earl Blumenauer Re: Indemnification Agreements |
| By: bmaz Wednesday September 1, 2010 1:34 pm |
Now that Earl Blumenauer has exposed the craven indemnification agreement the US government under the Bush/Cheney Administration gave to Halliburton/KBR, he should pursue the same types of agreements secretly given to telcom companies participating in the illegal wiretapping program.
State Secrets Non-Compromise Compromise Architect to Replace Kagan |
| By: emptywheel Monday May 10, 2010 10:18 am |
The great news just keeps coming. Remember the “new” state secrets policy DOJ announced last year? It basically amounted to a promise that the Attorney General would review any invocation of state secrets to make sure such an invocation was really really secret rather than just sort of secret but really embarrassing, along with a [...]
The Brits Refuse Secret Trials Even as Obama Doubles Down |
| By: emptywheel Wednesday May 5, 2010 5:25 am |
As bmaz reported last night, the Obama Administration has refused to accept Vaughn Walker’s ruling in al-Haramain–in fairly spectacular fashion (and yes, bmaz, Mary, MadDog and others did tell me this was going to happen). Meanwhile, across the pond, the folks from whom we got our legal system are refusing the very concept that the [...]
