&lt;p&gt;The irony of the conservative attack on “activist” judges is that by far the two most activist Supreme Courts in the last century have been the New Deal SCOTUS that routinely castigated and struck down Congress and Roosevelt bills during the 1930s and the Roberts court leading the Four Assholes of the Apocalypse. &lt;/p&gt;
&lt;p&gt;And consider the Roe v Wade court:&lt;/p&gt;
&lt;p&gt;Majority: 7, of whom 5 were appointed by Republican presidents&lt;/p&gt;
&lt;p&gt;Blackmun - appointed by Nixon&lt;br /&gt;
Burger - appointed by Nixon [chief]&lt;br /&gt;
Powell - appointed by Nixon&lt;br /&gt;
Brennan - appointed by Ike&lt;br /&gt;
