(ACLU) NEW YORK – “The government today stated it would no longer rely on evidence obtained through torture and other coercion in the habeas corpus case challenging the unlawful detention of Guantánamo detainee Mohammed Jawad. The American Civil Liberties Union filed a motion on July 1 to suppress Jawad’s statements, and today the Justice Department announced it would not oppose that motion.”

Right.

The irony of the conservative attack on “activist” judges is that by far the two most activist Supreme Courts in the last century have been the New Deal SCOTUS that routinely castigated and struck down Congress and Roosevelt bills during the 1930s and the Roberts court leading the Four Assholes of the Apocalypse.

And consider the Roe v Wade court:

Majority: 7, of whom 5 were appointed by Republican presidents

Blackmun - appointed by Nixon
Burger - appointed by Nixon [chief]
Powell - appointed by Nixon
Brennan - appointed by Ike
Stewart - appointed by Ike
Douglas - appointed by FDR
Marshall - appointed by LBJ

Minority: 2, of whom one was appointed by a Democratic president

Rehnquist - appointed by Nixon
White - appointed by JFK

You’d almost get the impression that Republican senators and movement conservatives have been and are being hypocritical about these matters.
