In the Oh those wild and crazy courts category, I noticed the flamboyant Chief Judge of the Ninth Circuit, the prolific writer Alex Kozinski has gotten back in the MSM news in a story involving “prurience.”

Since we are in the OT portion of this thread to some extent, I wanted to comment that while catching up on the news late tonight, after watching Jon Stewart reference Cliff Schecter’s book on McCain, (a quote where Johnny Mc told Cindy she was piling on makeup like a trollop and I’ll bet Cindy said “with all this beer money, if I feel like putting Freddie Krueger on my face, what the hell.”)

I stumbled on a story that there has been a halting or a suspension (not too common of a 9th Circuit case where Chief Judge Alex Kozinski’s now taken down website was discovered to have what Alex calls prurient material on it). In the spirit of legal research, I decided I had to see if prurient was something I’d know when I saw it. The reason I know I’d know it when I saw it of course was ’cause Justice Potter Stewart said I would when he and his law clerk wrote the opinion in Jacobellis v. Ohio, 378 U.S. 184 (1964)

This case involved the reversal of the conviction of an Ohio manager of Heights Art Theatre in Cleveland Heights, Ohio violated obscenity laws by showing a French film called The Lovers (Les Amants) which the state had deemed obscene.

So back to Chief Judge at the Ninth Circuit, Alex Kozinski. Apparently for reasons I haven’t drilled yet, Kozinski is presiding over a trial (fairly rare for an appeals court judge after mounting the appeals court bench).

Shame on the news media because actually Judge Kozinski didn’t post the images, his son did. You wouldn’t know that from their racy and inaccurate headlines but then newspapers aren’t counting on stupid Americans actually reading the story.

UPDATE: We connected recently with Cathy Catterson, a spokeswoman for the Ninth Circuit. She sent along the following statement:

With regard to the article in today’s Los Angeles Times, the computer server is maintained by one of the judge’s sons. It is not government property. All family members use it. Pictures, documents, other items of personal and family interest are stored on it. After the story broke, one of the judge’s sons contacted him to say he had uploaded much of the items referenced in the story. The server and its contents are a private matter. It was not meant to be accessible by others and the judge had no idea it was. Had he known, he would have been more careful of its contents.

In the spirit of legal research I used Way Back Machine to go to pages from Judge Kozinski’s blog which has been taken down and the pages say:

“Ain’t nothin’ here. Y’all best be movin’ on, compadre.”

And I didn’t even know that in Northern Californey it was common to use the contraction “y’all.” I always thought it was a Southern thing.
